Terms of Service
1. Scope and provider
These terms apply to all orders placed on bedtimewish.com.
The provider and your contractual partner is Stefan Horn, Kinderbuch Horn · BedtimeWish, Gutenbergstraße 10, 27570 Bremerhaven, Germany, email: bedtimewish@gmx.net (“we”, “us”).
We currently sell only to customers who live in the United States. BedtimeWish stories are in English.
2. What you get
We create a personal digital audio story (“BedtimeWish”) based on your details: an adventure featuring the child’s first name in the world you chose, taking into account your other details (additional favorite topics, your wish for the child, a companion, the child’s pet, favorite things, a personal message), narrated by a digital voice, with an individual cover and a lullaby, as an MP3 file. The story runs approximately 14–18 minutes, plus the lullaby; this is an approximate length, not a guaranteed exact duration.
Each story is newly created for every order with the help of AI services and narrated with a synthetic (digital) voice. That makes every BedtimeWish one of a kind; the wording, plot and cover can’t be previewed in advance. Your details are woven in by meaning; not every detail has to appear word for word.
The lullaby is not newly created for each order.
This is digital content that is not supplied on a physical medium.
3. Your details
Please only enter details you are allowed to use for this purpose, and no health information or other particularly sensitive information.
We won’t use content that is unlawful, infringes the rights of others or is clearly unsuitable for a children’s story. In that case we’ll get in touch; if no solution is possible, we’ll refund the purchase price.
4. How the contract is formed
The presentation on the website is not yet a binding offer.
You enter your details in several steps and see all of them on the summary page. There you can correct them using “Edit details” or the step navigation. You enter your email address and give your consent to the immediate start of creation. By clicking “Place order and pay · $7.99” you make a binding offer and are redirected to PayPal.
The contract is concluded when you approve the payment at PayPal and we collect the amount. We confirm receipt of your order and the contract by email without undue delay (order confirmation). If you cancel the process at PayPal, no contract is concluded.
After payment, we compare the country you told us with the country PayPal reports for your payment. If PayPal reports a country we don’t sell to, we check the order by hand before creation begins and contact you by email if needed. If you don’t live in one of our sales countries, we won’t create the BedtimeWish and will refund the full purchase price.
The contract language is English.
We store the contract text. The order confirmation contains your details, these terms and the cancellation policy; please keep it. We delete the order details according to the periods in our Privacy Policy.
5. Price and payment
The price is $7.99 (USD), one-time. The price is final – no sales tax or VAT is added. There are no shipping or other extra costs, and no subscription.
Payment is made via PayPal; PayPal’s terms also apply.
6. Delivery, download, start of creation
Delivery: Usually within a few minutes, and no later than 48 hours after payment.
As soon as your BedtimeWish is ready, you’ll receive an email with your personal download link; you can also see the status on your order page. The link is valid for 30 days from completion. Please save the MP3 file within that time. Once the period has ended and the production data has been deleted, we can’t provide the file again.
We begin creating your story right after receiving your payment and sending the order confirmation, i.e. before the cancellation period ends. We only do this because, before ordering, you expressly agreed and confirmed that you lose your right to cancel once performance begins. Details are in the Cancellation Policy.
7. Usage rights
You may use your BedtimeWish privately and without time limit: listen to it, save and copy it on your own devices, and give it as a gift within your family and private circle.
Public performance, making it publicly available (e.g. uploading it to platforms), selling it and any commercial use are not permitted.
8. Defects
The statutory rights for defects in digital content apply.
If your BedtimeWish is faulty (e.g. wrong name, faulty recording, missing lullaby), please email us at bedtimewish@gmx.net – we’ll fix it or create it again free of charge. Your statutory rights remain unaffected.
To make corrections, we need the order details. If they have already been deleted according to the periods in our Privacy Policy, we’ll ask you to send them again.
9. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under product liability law, and to the extent of any guarantee given.
For slightly negligent breaches of an obligation whose fulfilment is essential for the proper performance of the contract and on which you may regularly rely, our liability is limited to the foreseeable damage typical for this kind of contract. Otherwise, liability for slight negligence is excluded.
The statutory rights for defects (section 8) remain unaffected.
10. Right to cancel
Consumers have a right to cancel as set out in the Cancellation Policy; it expires early under the conditions described there. You can also cancel the contract online via “Cancel your order” at https://bedtimewish.com/withdraw.
11. Dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
12. Final provisions
These terms are governed by the laws of the Federal Republic of Germany. If you habitually reside in another country, you keep the protection of the mandatory consumer protection laws of that country.
If individual provisions are invalid, the rest of the contract remains in effect.
